Therefore, we comply with the requirements of the Federal Act on Data Protection (LPD), the Ordinance to the Federal Act on Data Protection (OLPD), and other provisions of Swiss legislation regarding data protection. Concerning the processing of personal data of individuals residing in the European Union, we also adhere to the provisions of the European General Data Protection Regulation (GDPR).

2 - SCOPE AND PURPOSE OF COLLECTION, PROCESSING, AND USE OF PERSONAL DATA

We collect personal information about you in the following cases and for the purposes listed below:

2.1 Website Visit

The legitimate interest of temporary storage of personal data and log files includes, in particular:

You can subscribe to our newsletter on our website. Your voluntary registration constitutes your consent to the processing of data provided during this registration.

When you provide us with your data, you authorize us to use the newsletter to send you information about current products, new products, events, and other news related to the platform and service offered by aquama® (including any subsidiary companies).

The following data, in particular, is collected at the time of registration:

2.3 Contact Form

When you contact us through the contact form, the information you provide is used to process your request.

To process your request, you are required to provide the following information:

  • Last name
  • Email address
  • Reason or subject of the request

If the registration is part of the execution of a contract to which you are a party or the implementation of pre-contractual measures, this constitutes another legal basis for data processing. Data about you is deleted as soon as it is no longer necessary for the purpose of collection.

2.4 Market Research

Data collected in the context of market research or surveys is not used for advertising purposes. Detailed information (including the evaluation of information about you) is available in the context of the specific survey or on the pages reserved for your responses. Your responses to surveys are neither disclosed to third parties nor published. Your participation in market research or surveys constitutes your consent for data processing.

3 - CUSTOMER ACCOUNT

3.1 Creating a Customer Account

By creating a customer account, which is secured by a password, you can order products, top up your virtual wallet, or view your information.

To create a customer account, you must provide the following information:

  • Title
  • First name
  • Last name
  • Company
  • Email address
  • Phone number
  • Home address
  • Password

Your email address and phone number allow us to communicate with you to best serve you. It also sometimes allows us to verify your identity (username) when you log in to your customer account.

When a user deletes their account, data associated with that account is deleted, subject to legal retention requirements. If you decide to delete your account, you must first back up your data. We are authorized to irreversibly erase all data kept during the user account's active period.

3.2 Customer Satisfaction Surveys

You may be contacted by aquama® to participate in customer satisfaction surveys. These surveys are anonymous. The purpose of such surveys is to improve your user experience with the aquama® platform and better meet user expectations.

4 - EMAIL ANALYSIS

To enhance electronic communication, we may analyze the behavior of email recipients. We analyze the links contained in these emails, noting, for example, which links are directly clicked. This information is associated with specific user profiles. We can identify the categories that primarily interest email recipients registered on our site. We use this information to personalize content and advertising campaigns for website visitors and email recipients.

5 - DELETION

We only process and store personal data about you for the time necessary to achieve the collection's purpose or in accordance with the applicable laws and regulations to which we are subject. When the purpose of storage no longer exists, or when a prescribed retention period expires, personal data is typically blocked or deleted in accordance with regulatory provisions. Furthermore, we delete data about you if you request it by sending an email to info@aquama.ch or making an online request, and if there is no legal or other obligation for us to keep or store the data.

6 - DISCLOSURE TO THIRD PARTIES

We only disclose data about you if you have explicitly consented, if required by law, or if the disclosure is related to the use of the website, responding to inquiries, processing requests, or any services you have requested. We may also disclose data about you to group subsidiaries in accordance with the regulations.

The use of data disclosed to third parties is strictly limited to the purposes mentioned in this policy. These third-party companies are required to provide the same level of data protection as we do. If the level of data protection in the destination country is not considered equivalent to that in Switzerland, or as required by the GDPR, we ensure, through contractual means, that personal data about you is protected at all times in accordance with Swiss regulations or the European Union's General Data Protection Regulation.

7 - TARGETING

Data is collected for the purpose of optimizing our promotions and the entire online offer through the use of cookies. This data is not used to personally identify you but is solely used for pseudonymous evaluation of website usage. Your data is never merged with the personal data we store. This technique allows us to provide you with relevant content (advertising or special offers and/or services). The goal is to make the offers we present to you as attractive as possible and to show you products and services that match your interests.

You can block targeting at any time by refusing the relevant cookies or disabling them in your browser's menu bar (for more details, please see the "Cookies" article).

8 - RETARGETING

Our websites may use so-called retargeting techniques. These increase the relevance of the content presented to you and allow you to view personalized ads. We believe that this type of display, which takes your interests into account, is more useful to you than impersonal advertising. The insertion of such advertising material on our partner's websites is made possible through the use of cookies and by analyzing the user's previous behavior. This form of advertising is entirely anonymous. Personal data about you is never stored, and no user profile is merged with it.

9.1 What are Cookies?

Our website uses what are called cookies. Cookies are pieces of information sent by our web server or third-party web servers to users' web browsers. These are then stored in these browsers before being retrieved later. They can take the form of small files or other information storage media.

10 - PIXELS, LOCAL STORAGE, AND SIMILAR TECHNIQUES

We also use other techniques such as pixel tags and local storage. We use these techniques when they have a legitimate interest, such as identifying particularly popular features to provide users with a personalized experience and ads.

Pixel tags (also called web beacons or web bugs) are small units of code inserted into a web page, mobile app, or ad. These tags can extract specific information about your browser and device, including the operating system, browser type, device brand and model, referring web page, visited website, IP address, and similar information.

We may use the following pixel tags:

  • Bing ads
  • Hotjar

We also use pixel tags in our newsletter. Each newsletter sent provides information about the email address used, the number of newsletters sent, and their subject. This technique also identifies addresses that have not yet received the newsletter, those that have received it, and those for which delivery has failed. We analyze open, click, and unsubscribe rates. This data is used to create statistics to optimize the content and format of the newsletter. This allows us to more accurately tailor the information and offers in our newsletter to the specific interests of our recipients. The pixel tag is destroyed when you delete the newsletter. You can block the pixel tag from our newsletter. In this case, please configure your email program, if not already set by default, to read messages in plain text (not HTML).

11 - INTERNET ANALYSIS TOOLS

11.1 Principles

Our website may use the features of the following internet analysis services:

11.2 Google Analytics

Based on our legitimate interests (including the interest in analyzing, optimizing, and cost-effective operation of our online offering), we use Google Analytics, an internet analysis service provided by Google Inc. ("Google," 1600 Amphitheater Parkway Mountain View, CA 94043, USA). Google uses cookies. Information generated by cookies regarding your use of this site (including your IP address) is transmitted to Google servers in the United States, where it is stored. Google is certified under the data protection shield, a mechanism that ensures compliance with European data protection laws. Google processes this information on our behalf to evaluate your use of our online offering, compile reports on the activities of our online offering, and provide us with other services related to our online offering. 11.3 Google AdWords

Based on our legitimate interests, we use the "Google AdWords" advertising program, one of the Google Online Marketing services. Google AdWords places a cookie on your computer (the "conversion cookie") if you access our website through a Google ad. This cookie expires after 30 days and does not allow identification. If you visit certain pages of our website before the cookie expires, Google and we can determine whether a visitor clicked on the ad and was redirected to our site. Each advertiser is assigned a distinct cookie. Therefore, it is impossible to trace cookies via advertisers' websites. The information collected through the conversion cookie is used to generate conversion statistics for AdWords advertisers who have opted for conversion tracking. We do not obtain any information to personally identify you.

Information collected by the cookie regarding your use of this site is typically transferred to Google servers in the United States, where it is stored. Based on the information collected, categories related to your interests are associated with your browser. These categories determine the type of advertising you receive.

We use the data collected about you through the mentioned cookie (known as conversion tracking) for the following purposes:

11.4 Google DoubleClick

We use Google's DoubleClick feature on our websites to evaluate their usage and enable us, as well as Google and other DoubleClick advertisers, to present relevant ads to the user. For this purpose, a cookie is stored on your computer's hard drive. When used, this cookie assigns a pseudonymous identification number to your browser and records information about ads displayed on your browser and those you view.

Information collected by the cookie regarding your use of the websites is typically transferred to Google servers in the United States, where it is stored. Based on the information collected, categories related to your interests are associated with your browser. These categories determine the type of advertising you receive.

If you wish, you can change your browser settings or permanently disable the DoubleClick cookie by installing a specific extension. This extension keeps your deactivation settings for this browser, even if you delete all cookies. 11.5 Google Tag Manager

Google Tag Manager is a service that allows marketing professionals to manage tags placed on websites through a single interface. We use Google Tag Manager to integrate Google's analytics and marketing services into our website and utilize them. The Tag Manager tool itself, which deploys the tags, is a cookie-less domain and does not collect personally identifiable information. However, this tool triggers other tags that may collect data. Google Tag Manager itself does not have access to this data.

11.6 Affilinet

Affilinet is a service provided by Affilinet GmbH, Sapporobogen 6, 80637 Munich, Germany. Affiliate systems work on the principle of agency commissions. Affiliation is carried out on the web through a link. This affiliate link contains a unique code associated with the affiliate publisher to allow the advertiser to identify them. In simple terms, this means that the advertiser, through the link containing the partner's identifier, can determine which publisher redirected the customer. The affiliate receives a commission for every click on advertising content ("Click"), the transmission of qualified customer data ("Business Contacts"), and for each sale ("Sale"). Therefore, unlike the advertiser (who is also the provider of the program and operator), who offers goods or services, the affiliate serves as an interface between the advertiser and potential customers.

The user who clicks on one of these affiliate links is redirected to the corresponding advertiser's page. The settings transmitted at the same time allow specific affiliate publishers to be attributed the sales they generated. This method is called tracking. Cookie-based tracking, for example, allows you to associate a visitor with a cookie and track them. Cookies stored on the visitor's hard drive enable their recognition and subsequent tracking (even in the case of delayed or interrupted interactivity). Cookie-based tracking is the most commonly used method in affiliate marketing to associate a person with an affiliate.

11.7 Hotjar

Hotjar is an analysis service provided by Hotjar Ltd. (St Julian’s Business Center, Elia Zammit Street, St Julian’s STJ 1000, Malta, Europe). We use Hotjar to better understand our users' expectations and optimize this service and its usage. The Hotjar program allows us to better understand our users' behavior (such as time spent on specific types of pages, links they choose to click on, what they like or don't like, etc.). With this information and feedback from our users, we can enhance and improve our services. Hotjar uses cookies and other techniques to collect data about our users' behavior and their devices, including their IP addresses (captured and stored in anonymous form only), screen size, device model (unique device identifiers), browser information, geographic location (country only), and preferred language for display on our website. Hotjar stores this information in an anonymous user profile. Hotjar and we are committed to never using this information to identify individual users or to associate it with additional user data. 11.8 Adform

Adform is a service provided by Adform A/S (Wildersgade 10B, 1408 Copenhagen, Denmark). This service is used for tracking and managing online advertising campaigns when there is a legitimate interest in doing so.

Adform uses cookies that are stored on your computer but do not contain personal data such as your name, email addresses, or other personal information. These cookies contain technical information such as ad support display frequency and display date, the browser used, or the operating system installed. It is impossible to personally identify you using this process. Adform does not store complete IP addresses; the last octet is always forgotten.

You have the right to accept or reject cookies for tracking purposes. Decline them by clicking on the following link: https://site.adform.com/privacy-policy-opt-out. By doing so, an opt-out cookie will be stored on your device, indicating to our technical systems that no further tracking of new data or storage of cookies is allowed in the future.

11.9 Outbrain

This site uses technology from Outbrain Inc. ("Outbrain," 39 W 13th Street New York, NY 10011, USA). This technology allows for targeted advertising to internet users who have shown an interest in our offers on our partners' websites or to collect data analysis about this type of user. This technology is based on user behavior analysis using cookies. This advertising will only appear on Outbrain, Outbrain Engage, or Outbrain Extended Network. If you do not wish to see interest-based ads, you can disable this feature here.

11.10 Plista

Our website/application relies on fully automated recommendation technology developed and provided by plista GmbH, Torstrasse 33, 10119 Berlin. We aim to improve the relevance of our website/application with this technology by recommending articles and ads that match your personal interests (referred to as "interest-based ads").

In order to provide interest-based advertising, plista evaluates information about user behavior on a website/application through its partner network. This usage data is collected by plista using cookies and is associated with a random identifier (cookie identifier) or transmitted to plista with an advertising identifier (advertiser identifier or other identifier) by the relevant provider (in mobile app environments).

12 - SOCIAL MEDIA EXTENSIONS AND FEATURES

12.1 What are social media extensions?

Extensions are small programs or software that allow you to customize the software and add features according to your expectations. Many applications, such as image editing software, media players, or web browsers, provide the desired features for the average user in their basic version. These programs are becoming increasingly flexible and offer possibilities to enhance them through extensions or modules.

12.1 Which extensions do we use?

On our website, we have created links to our profiles on the following social networks:

  • Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA
  • Instagram Inc., 1601 Willow Road, Menlo Park, California 94025, USA
  • Twitter Inc., 1355 Market Street, Suite 900, San Francisco, CA 94103, USA

When you click on a link to one of our social media profiles, a direct connection is established between your browser and the server of the respective social network. The network is then informed that you have visited our website from your IP address and that you have activated the link. If you click on the access link to a social network while being logged into your user account, the content of our page may be associated with your profile on the network. The network can then directly associate your visit to our website with your user account and provide us with personal data such as your name, email address, location, friend list, and profile picture. This data enables us to offer certain features on our pages. If you want to prevent this data transmission, you must log out before clicking on the links in question. An association takes place in any case if you log into the respective network after clicking on the link.

If you log into Facebook, Google, or Instagram while browsing our website while logged into your user account, the respective provider can also associate this visit with your user account page. If you interact with an extension, such as clicking the "Like" or "g+1" button, the corresponding information is also directly transmitted to a server of the provider in the United States, where it is stored. This information is also published through your user account on the corresponding social network and displayed on it, visibly to your contacts.

Even if you do not log into the extension provider while visiting our website, the data collected by the extension can be associated with your user account. An extension installs a cookie with an identifier each time the internet page is activated. Since your browser sends this unsolicited cookie each time it connects to a server of the respective provider, Facebook, Google, and Instagram could theoretically create a profile indicating which internet site the user associated with the identifier activated. If necessary, it would then be possible to associate this identifier with a person, for example, when later logging into the provider's site.

If you do not want the extension provider to associate this information with your profile, you must log out of these services before visiting our website. In addition, you can enable the option "Block cookies from third-party providers" in your browser settings, so that it cannot send cookies to the server of the social network in question. However, if you make this setting in your browser, other data cross-referencing features, in addition to extensions, from other providers may be disabled.

Please note that the law requires certain data to be retained for a specific period. Therefore, we are obliged to retain such data until the end of that period. We lock this data in our computer systems and use it only to comply with legal requirements.

14 - WEBSITE USAGE BY MINORS

This website is intended for an adult audience. Minors are prohibited from providing us with information that would identify them or from connecting to use our services. If we notice the presence of such information in our databases, we will delete it immediately. The child's father, mother, or legal guardian is authorized to contact us to request the deletion of data or the user account created. In this case, the person making the request must provide official proof of their parent or guardian status.
